การเปิดร้านอาหารในยูนนาน

ปัจจุบันร้านอาหารไทยในนครคุนหมิงเปิดขึ้นใหม่จำนวนมาก เป็นเพราะความนิยมจากผู้บริโภคคุนหมิงที่เพิ่มมากขึ้น โดยเฉพาะช่วง 2 ปีที่ผ่านมามีร้านอาหารไทยที่ได้รับความนิยมจากผู้บริโภค ได้แก่ Moonlight Corner, Yaowali, Sukhothai, Laike Bali, Baan Thai. ฯลฯ ผู้ประกอบการไทยที่สนใจจะเข้ามาเปิดร้านอาหารในยูนนาน ควรทราบ กฎระเบียบ ที่เกี่ยวข้อง คือ

I. นักลงทุนต่างประเทศจะต้องได้รับความเห็นชอบจากหน่วยงานการลงทุนจากต่างประเทศ (Application for examining & approving) คือ

1.2 เอกสารประกอบการขอสำหรับการอนุมัติ (List of qualified documents required by approval office)
A: เอกสารที่ต้องการสำหรับการร่วมทุนกับนักลงทุนจีนด้านร้านอาหาร (List of documents required for setting of joint venture catering enterprise)
a. Application for setting up a catering enterprise
b. Feasibility study report
c. Contract and articles of joint venture catering enterprise
d. Letter of intention by all partners involved
e. List of equipment to be imported within total value of investment
f. Registration of the catering enterprise’s name
g. Application for industrial and commercial registration
h. Identification certificate of management personnel
i. Certificate of legality of the business operation
j. Certificate of creditability for each party of the new catering enterprise
k. Land used certificate
l. Opinions of departments concerned for environmental protection, public security, fire fighting, labour safety and sanitation facilities

B: เอกสารประกอบการขออนุมัติ สำหรับนักลงทุนต่างชาติ 100 % (List of documents required for setting up solely foreign-invested catering enterprise)
a. Application for setting up a catering enterprise
b. Feasibility study report
c. Articles of organization & management
d. List of legal representatives (or members of the board of directors)
e. Creditability certificates and other legal certificates of foreign investors
f. Opinions of local government at or above county level

1.3 เมื่อหน่วยงานที่เกี่ยวข้องได้ตรวจสอบและอนุมัติ จะออกใบอนุญาตสำหรับการประกอบธุรกิจ (The approval office shall issue to the applicant the approval document if the application has passed general examination. A certificate of approval will also be issued together with the business license. )

II. การขออนุญาตเกี่ยวกับสุขอนามัย (Application for hygiene license of new catering enterprise)

2.2 เอกสารประกอบการขออนุญาต (List of documents required by above organization)
A. Contacting information (Name, Address, Tel, Fax etc.)
B. Application report for hygiene license
C. Floor plan of business place
D. Arrangement floor plan for equipment of restaurant and explaining for condition of hygiene equipment
E. Source of dishes information (what dishes….? from where….?)
F. Medical certificate
G. Hygiene management organization & regulation of restaurant

III. นักลงทุนต่างชาติ จะต้องจดทะเบียนกับหน่วยงานอื่นที่เกี่ยวข้องด้วย คือ ศุลกากร หน่วยปริวรรตเงินตรา หน่วยงานด้านภาษี หน่วยงานแรงงานและการบริหารการเงิน โดยใช้เอกสารใบอนุญาตประกอบธุรกิจและสุขอนามัยประกอบการจดทะเบียนกับหน่วยงานข้างต้น (Enterprise with foreign investment should register with the customs, Foreign Exchange Control Bureau, Tax Bureau, Labor Administration and Financial Administration with certificate of approval, business license and hygiene license. )

IV. ภาษีสำหรับร้านอาหาร(Taxation for restaurant)
4.1 Business income tax rate is 25%;
4.2 Business tax rate is 5%.

V. ประมาณการค่าเช่าประกอบธุรกิจร้านอาหาร (Rental fees for business place)
In Kunming City, the rental fees for restaurant in the range of RMB 80-500 Yuan per square meter per month.

VI. การจ้างพ่อครัวต่างชาติ (Hiring foreign cook who works in foreign-invested catering enterprise in Kunming,)
6.1 ต้องได้รับการอนุมัติการจ้างพ่อครัวต่างชาติTo Approval Office to apply for employing foreign cook
